LAW IN THE FACE OF IRRATIONALITY: Psychoanalytic Deciphering of the Coup Act of January 8th and its Legal Implications for Democracy.

Abstract

The events of January 8, 2023, exposed a profound fracture in Brazilian democracy, highlighting the collision between the legal order and the apparent irrationality of a coup attempt. This article proposes an interdisciplinary analysis, combining Law and Psychoanalysis, through a bibliographic review, developed by the deductive method with a critical focus, to decipher the complex behaviors that culminated in the attempt to subversion of the Democratic Rule of Law. We investigate the legal implications of the events, qualifying the crimes, while psychoanalysis offers lenses to understand the subjectivity of former president Jair Messias Bolsonaro and the psychodynamics of his followers. Through concepts such as the psychology of the masses, identification with the leader, and the function of the ego ideal, psychoanalysis unveils the unconscious motivations that fueled the adherence and fervor of a group that radically opposed the institutions. The study demonstrates how irrationality, often perceived as random, possesses psychic logics that, when not understood, undermine democratic stability. The legal implications are vast, ranging from the need for criminal accountability of those involved to the strengthening of legislation and education for the continuous defense of the democratic regime.
